{"id":1600,"date":"2022-06-15T15:20:55","date_gmt":"2022-06-15T19:20:55","guid":{"rendered":"https:\/\/communicator.pef.org\/?p=1600"},"modified":"2024-04-10T10:04:37","modified_gmt":"2024-04-10T14:04:37","slug":"if-you-experience-discrimination-pef-will-help-you-fight-it","status":"publish","type":"post","link":"https:\/\/communicator.pef.org\/issue\/volume-40-no-5\/if-you-experience-discrimination-pef-will-help-you-fight-it\/","title":{"rendered":"If you experience discrimination, PEF will help you fight it"},"content":{"rendered":"<p><span data-contrast=\"none\"><img loading=\"lazy\" decoding=\"async\" class=\"size-full wp-image-1601 alignright\" src=\"https:\/\/communicator.pef.org\/wp-content\/uploads\/sites\/2\/2022\/06\/PEF_JAAAC.jpg\" alt=\"Joint Affirmative Action Advisory Committee Logo\" width=\"300\" height=\"300\" srcset=\"https:\/\/communicator.pef.org\/wp-content\/uploads\/sites\/2\/2022\/06\/PEF_JAAAC.jpg 300w, https:\/\/communicator.pef.org\/wp-content\/uploads\/sites\/2\/2022\/06\/PEF_JAAAC-150x150.jpg 150w, https:\/\/communicator.pef.org\/wp-content\/uploads\/sites\/2\/2022\/06\/PEF_JAAAC-125x125.jpg 125w\" sizes=\"auto, (max-width: 300px) 100vw, 300px\" \/><em>June 17, 2022 &#8212; <\/em>Workplace discrimination is banned in the PEF contract.\u00a0 Nevertheless, some members feel they do experience it, especially when they apply for a promotion or a transfer.<\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335559739&quot;:160,&quot;335559740&quot;:259}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"none\">Article 36 of the contract between PEF and the state is relatively short.\u00a0 It says PEF will admit all state employees in the Professional, Scientific and Technical (PS&amp;T) bargaining unit to membership and it will represent them without regard to race, creed, color, national origin, age, sex or handicap.\u00a0\u00a0<\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335559739&quot;:160,&quot;335559740&quot;:259}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"none\">Article 36 further says the state will continue its established policy against all forms of illegal discrimination.\u00a0\u00a0<\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335559739&quot;:160,&quot;335559740&quot;:259}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"none\">Then, it says that PEF and the state shall form a Joint Affirmative Action Advisory Committee (JAAAC) to develop appropriate recommendations on matters of mutual interest in the areas of equal employment and affirmative action.<\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335559739&quot;:160,&quot;335559740&quot;:259}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"none\">PEF has appointed seven members to represent it on this joint committee.\u00a0 The three PEF co-chairs are Vice President Darlene Williams, Tamara Martin and Mohammed Chowdhury.\u00a0 The union also is represented by Bellew McManus, Ade Oluwo, Cheryl Wallace and retiree Charles Roland.\u00a0 The committee meets quarterly.\u00a0\u00a0<\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335559739&quot;:160,&quot;335559740&quot;:259}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"none\">\u201cWe want people to realize we are active, engaged and achieving positive results for members.\u00a0 The committee is doing a great job,\u2019\u201d Williams said.<\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335559739&quot;:160,&quot;335559740&quot;:259}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"none\">The JAAAC focuses on situations where a member or group of members feel they are being illegally discriminated against or harassed.\u00a0 Williams said the committee is aided by consultant Eric Josey in helping members file timely complaints with the correct governmental bodies.\u00a0\u00a0<\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335559739&quot;:160,&quot;335559740&quot;:259}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"none\">\u201cWe often use the state Freedom of Information Law to gather evidence, because we need to prove their treatment is discriminatory,\u201d Williams said.\u00a0 \u201cWe may need statistics or data and it might need to come from the agency.\u00a0 The agencies aren\u2019t pushing back, but they are really slow to move.\u00a0 They say they will look into it.\u201d<\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335559739&quot;:160,&quot;335559740&quot;:259}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"none\">Williams cited the example of a case where management wouldn\u2019t let a member sit for a promotion exam.\u00a0 \u201cI don\u2019t think they ever gave her an excuse for why she couldn\u2019t take it,\u201d Williams said.\u00a0 \u201cWe \u2018FOILed\u2019 the statistics on promotions at that agency and found that promotions of minorities was so low.\u00a0 We inundated them with evidence. All of a sudden, they allowed her to take the exam. This is outright racism.\u201d<\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335559739&quot;:160,&quot;335559740&quot;:259}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"none\">Members who feel they are experiencing discrimination should go first to their PEF field representative who can give them a complaint form to complete.\u00a0 Then the committee will help them navigate the paperwork.<\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335559739&quot;:160,&quot;335559740&quot;:259}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"none\">\u201cOur committee members are committed to ending injustice,\u201d Williams said.\u00a0 \u201cAs people are beginning to realize that we are there to help them, the number of complaints we are receiving from them is going up.\u00a0 We want to be part of making real change for the future.\u00a0 We want to shine a light on people who are suffering silently.\u201d\u00a0<\/span><\/p>\n<p><em>Note: If you want to file an employment discrimination form with PEF, please <a href=\"https:\/\/www.pef.org\/pef_files\/files\/pdf\/DiscriminationReferralForm.pdf\">fill out this form<\/a> and file it with your PEF Field Representative.
